Frequently Asked Questions on Belgian UBO register: new update

In previous news flashes we already informed you about the implementation of the UBO register, the extension of the first registration deadline and a first update of the frequently asked questions. 

After a first update on 2 April 2019, the Federal Public Service Finance (FPSF) published a new version of the frequently asked questions (FAQ) on 19 July 2019. The updated FAQ includes, amongst others:

  • An exemption for listed companies (if already subject to disclosure obligations);
  • The confirmation that publicly owned entities (gecontroleerd door een openbare rechtspersoon / contrôlée par une personne morale de droit public) are subject to the general rules as applicable to all companies, including additional guidance on which persons can qualify as UBO in this case; 
  • Further clarification on how the matrimonial property regime of spouses can impact the qualification as UBO;
  • Additional practical information regarding some technicalities of the registration process. 

Finally, we would like to remind you that the deadline for the registration in the UBO register is 30 September 2019.
